On What Legal Grounds Can I Sue New York Life?

Whether you are dealing with a denied disability claim, a life insurance dispute, or an issue with an annuity, taking on a titan like New York Life Insurance Company is a daunting prospect. They have virtually unlimited resources to defend their decisions, but they are not above the law.

At DarrasLaw, we are nationally recognized for our ability to hold major insurers accountable. If New York Life has failed to honor your policy, there are several powerful legal grounds upon which you can file a lawsuit.

1. ERISA Violations (Federal Law)

If your New York Life policy was provided by your employer as a benefit, your lawsuit will likely fall under the Employee Retirement Income Security Act (ERISA). This is a complex federal law that governs most group disability and life insurance claims.

Under ERISA, you can sue New York Life for:

  • Wrongful Denial of Benefits: Challenging their decision that you do not meet the definition of “disabled.”
  • Procedural Violations: Failing to provide a “full and fair review” or missing strict federal deadlines for claim decisions.
  • Breach of Fiduciary Duty: Failing to act solely in the interest of the plan participants.

Note: Under ERISA, you must generally exhaust the internal “administrative appeal” process before you can step foot in a federal courtroom.

2. Breach of Contract (Individual Policies)

If you purchased your policy directly from an agent (an “individual policy”), your lawsuit is governed by state contract law rather than federal ERISA law. In these cases, you can sue for Breach of Contract.

This occurs when New York Life fails to fulfill its specific promises outlined in your policy, such as:

  • Failing to pay the death benefit to a rightful beneficiary.
  • Terminating long-term disability payments without a change in your medical condition.
  • Misinterpreting policy language to exclude coverage for a specific illness or injury.

3. Insurance Bad Faith

In many states, insurance companies have a “covenant of good faith and fair dealing.” When New York Life acts dishonestly or unreasonably to avoid paying a valid claim, you may have grounds for a Bad Faith lawsuit.

Examples of bad faith conduct include:

  • Unreasonable Delays: Dragging out an investigation for months or years without a valid reason.
  • Biased Medical Reviews: Relying on “paper-only” reviews from doctors who never examined you, while ignoring the clear evidence from your treating physicians.
  • Misrepresenting Policy Facts: Intentionally lying about what your policy covers to trick you into dropping your claim.

The Advantage: Unlike ERISA cases, a successful bad faith lawsuit can sometimes result in punitive damages—awards meant to punish the insurer for their conduct.

4. Consumer Fraud and Deceptive Trade Practices

In some jurisdictions, you can sue based on how the policy was sold to you. If a New York Life agent used deceptive marketing tactics or “vanishing premium” schemes to lure you into a policy that didn’t perform as promised, you may have grounds under state consumer protection statutes.

Why Experience with New York Life Matters

New York Life often uses specific tactics to justify denials, such as claiming a condition is “mental” rather than “physical” to limit benefits to 24 months, or using surveillance footage out of context.

At DarrasLaw, led by founding partner Frank N. Darras, we have seen every trick in the book. We have recovered nearly $1 billion for policyholders nationwide because we know how to dismantle New York Life’s defenses at the appeal level and in the courtroom.
